Terms of Service

These Terms of Service ("Terms") govern your access to and use of TweetWhale ("the Service"), a software platform for managing X (Twitter) outreach across accounts you own or are authorized to operate. By creating an account or using the Service, you agree to these Terms.

1. Eligibility and your accounts

  • You must be at least 18 years old and legally able to enter into contracts.
  • You may only connect X accounts that you own or have explicit written authorization to operate.
  • You are solely responsible for the security of your account credentials, session tokens, and proxy configurations stored with the Service.

2. Acceptable use

  • Do not use the Service to send spam, harass anyone, distribute malware, or engage in fraud, scams, or deceptive practices.
  • Do not use the Service in ways that violate X's Terms of Service, automation rules, or applicable law.
  • You are responsible for the content of every message sent through the Service and for obtaining any consents required by law (e.g., anti-spam regulations) before messaging recipients.
  • We may suspend or terminate access immediately if we reasonably believe your use is unlawful, abusive, or harms the Service or its other users.

3. Automation risk and account safety

Automating activity on X carries inherent risk, including temporary restrictions or permanent suspension of connected accounts by X Corp. The Service provides safety controls (per-account daily caps, pacing, proxies) but cannot guarantee any account will avoid enforcement action. You assume all risk associated with connecting and automating your accounts.

4. Beta status

While the Service is in beta, features may change or be discontinued, plans and limits are assigned manually, and the Service is provided without uptime commitments. Pricing published after beta may differ from any amounts communicated during beta.

5. Subscriptions and billing

  • Paid plans renew automatically until cancelled where billing is enabled.
  • Fees are non-refundable except where required by law or explicitly stated otherwise.
  • We may change pricing with reasonable notice; changes apply to future billing cycles.

6. Intellectual property

We retain all rights to the Service itself. You retain all rights to your content (message templates, lead lists, account data). You grant us a limited license to process that content solely to operate the Service on your behalf.

7. Disclaimers and limitation of liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, TweetWhale shall not be liable for indirect, incidental, special, consequential, or punitive damages, nor for lost profits, data, or X account suspensions arising from your use of the Service. Our aggregate liability shall not exceed the amount you paid us in the twelve months preceding the claim.

8. Termination

You may stop using the Service at any time. We may suspend or terminate your access for material breach of these Terms. Upon termination, we will make your data available for export for a reasonable period before deletion, except where retention is required by law.

9. Changes and contact
